Abstract

A Deed of Sale and Purchase is an authentic deed drawn up by a Land Deed Making Official (Pejabat Pembuat Akta Tanah – PPAT) and serves as a legal product required as evidence of the transfer of land rights. The provisions regarding Temporary PPATs are regulated in Government Regulation No. 24 of 2016 and Regulation of the Head of the National Land Agency No. 23 of 2009. According to Article 5 paragraph (3) of Government Regulation No. 24 of 2016, in order to serve the community in the preparation of PPAT deeds in areas where there are insufficient PPATs, or to serve specific community groups in the preparation of certain PPAT deeds, the Minister may appoint a Sub-District Head (Camat) or a Village Head (Kepala Desa) to provide deed-making services in areas lacking adequate PPATs. The method used in this research is juridical-normative, namely library-based legal research utilizing primary, secondary, and tertiary legal sources. The research approaches employed include the statutory approach, case approach, analytical approach, and conceptual approach. Legal materials were collected by identifying and reviewing book literature, journals, and other sources of legal materials. Legal material analysis was conducted using: 1) grammatical interpretation, 2) systematic interpretation, and legal construction methods, with data analyzed qualitatively.
